1. Introduction

Welcome to Mindmil Assessments (“Mindmil”, “Company”, “we”, “our”, or “us”).
These Terms of Use (“Terms”) govern your access to and use of our website, online assessment platform, tools, psychometric tests, cognitive assessments, analytics dashboards, reports, and all related services (“Services”).

By accessing, registering on, purchasing from, or using the Services, you (“you”, “your”, including any organisation you represent) agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use the website or the Services.

The Services are owned and operated by Mindmil Assessments, based in New Delhi, India.

2. User Eligibility

You may use the Services only if:

  1. You are at least 18 years of age,

  2. Competent to enter into a legally binding contract as per applicable Indian law, and

  3. For corporate registrations, you are duly authorised to act on behalf of your organisation.
    If you do not meet these conditions, you are not permitted to use the Services.

3. Scope of These Terms

These Terms apply to:

  • The Mindmil website

  • All online psychometric & cognitive assessment tools

  • User dashboards, test results, reports

  • All software, content, documentation, and features provided by Mindmil
    Certain Services may require you to accept additional agreements, including:
  • Assessment purchase agreements

  • Corporate subscription agreements

  • Data processing terms

  • Privacy Policy

  • Payment and billing terms

Where such additional terms apply, those terms will prevail for that specific Service.

4. Modifications to Terms and Services

Mindmil reserves the right to update or modify these Terms at any time. Continued use of the website or Services after updates constitutes acceptance of the revised Terms.

Mindmil may, at its sole discretion:

  • Add, modify, suspend, or discontinue any feature

  • Update pricing, subscription plans, or access models

  • Restrict or terminate access to certain Services

Notice may be provided via email, website notification, or through the user dashboard.

5. Privacy & Data Protection

By providing personal or organisational data, you confirm that:

  • You have the legal right and necessary consents to share such information

  • You permit Mindmil to process the information to deliver the Services

Mindmil collects, stores, and processes personal data as described in its Privacy Policy, which forms an integral part of these Terms.

Psychometric and cognitive assessment responses, scores, and analytics are treated with confidentiality and used solely to deliver and improve the quality of assessments.

6. Licence and Ownership

All intellectual property relating to:

  • Assessment tools and test items

  • Algorithms, scoring mechanisms, and cognitive models

  • Test questions, psychometric scales, and content

  • Software, dashboards, and digital interfaces

  • Logos, branding, graphics, and design
    Is the exclusive property of Mindmil Assessments or its licensors.

Mindmil grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services solely for the purpose for which they are offered.

You may not:

  • Copy, reproduce, modify, or create derivative works

  • Reuse or resell assessment content

  • Reverse engineer, decode, or extract test logic

  • Use Mindmil content to train AI models or machine learning algorithms

  • Share login credentials or allow unauthorised access

Any unauthorized use will result in immediate termination and may lead to civil or criminal action.

7. Restrictions on Use

You agree NOT to:

  1. Interfere with the platform, attempt to bypass security, or test system vulnerabilities

  2. Deploy bots, scrapers, crawlers, or automated tools to access the website

  3. Use Mindmil assessment content for training AI or ML systems

  4. Reverse engineer or extract assessment items, test constructs, or scoring rules

  5. Use assessment results for purposes not permitted by law

  6. Upload inaccurate, misleading, or fraudulent personal information

  7. Attempt to cheat, manipulate, or influence test outcomes in any form
    Mindmil reserves the right to suspend or terminate access for violations.

8. Payment and Access

  • Assessments and tools are accessible only after full payment unless otherwise agreed for corporate accounts.

  • All fees are non-refundable except where required by applicable law or as per Mindmil’s refund policy.

  • Corporate clients may be billed as per contractual terms.
    Mindmil does not store or process payment card information; payments are handled by secure third-party providers.

9. Test Integrity & Validity Disclaimer

Psychometric and cognitive assessments aim to evaluate behavioural tendencies, aptitudes, and cognitive patterns. However:

  • They are not medical or clinical diagnostics

  • Results are indicative and depend on user honesty and conditions

  • Mindmil does not guarantee accuracy for decisions made by employers, institutions, or individuals
    Mindmil is not responsible for hiring decisions, admissions outcomes, career choices, or any consequences arising from assessment interpretations.

10. Outbound and Inbound Links

Mindmil may provide links to third-party websites for convenience.
Mindmil does not endorse and is not responsible for:

  • Content

  • Security

  • Accuracy

  • Privacy practices

Any inbound linking to Mindmil’s website must not:

  • Misrepresent association with Mindmil

  • Display Mindmil’s logo without permission

  • Frame or replicate Mindmil content

  • Suggest endorsement without prior written consent

  1. Termination of Access

Mindmil may suspend or terminate access at its discretion if:

  • These Terms are violated

  • Payment obligations are breached

  • Test integrity is compromised

  • Platform misuse or attempted hacking occurs

Upon termination:

  • All licences granted to you will terminate

  • Access to assessments, dashboards, and reports may be revoked

  • Mindmil is not liable for loss of data due to termination

  1. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis.

Mindmil makes no warranties regarding:

  • Accuracy, completeness, or reliability of assessment results

  • Suitability of assessments for specific hiring or career decisions

  • Uninterrupted or error-free platform performance

  • Compatibility with your devices or systems
    You use the Services at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law:

  • Mindmil shall not be liable for indirect, incidental, special, or consequential damages, including loss of profit, business opportunity, or data.

  • Mindmil’s total liability for any claim shall not exceed the total amount paid by you in the three (3) months preceding the claim.

This limitation does not apply to:

  • Fraud or willful misconduct

  • Breach of confidentiality

  • IP infringement

14. Compliance With Law

You agree to use the Services in compliance with:

  • Indian laws

  • IT Act, 2000

  • Data protection requirements

  • Any industry-specific compliance applicable to your organisation
    Mindmil operates from India, and export of software or data may be restricted under Indian law.

15. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India.
Courts located in New Delhi, India shall have exclusive jurisdiction over all disputes.

16. General Provisions

  • You may not assign your rights under these Terms.

  • If any part of these Terms is held invalid, the remainder will still apply.

  • No waiver of a term will be considered a continuing waiver unless explicitly stated in writing.

  • You may retain a copy of these Terms for your records.
